JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Goraul P.S. Case No. 312 of 2017 for the offenses under Sections 398 and 427 of the Indian Penal Code. Learned counsel for the petitioner would submit that allegation is that 15-16 unknown persons were trying to commit theft of cash from the ATM of Central Bank of India. The petitioner has not been put on Test Identification Parade. The petitioner is in custody since 29.11.2018. Considering the fact that the petitioner is not named in the FIR nor he has been put on TIP notwithstanding the fact that he is in custody since 29.11.2018, the Court is inclined to grant bail to the petitioner.
