JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Atri PS case no. 87 of 2017 registered for the offences punishable under Sections 341/ 323/ 324/ 379/ 504/ 506/34 of the Indian Penal Code.

The allegation is that when measurement of land was being conducted in presence of the Sarpanch and Panchayat Samittee, one co-accused Pradeep Kumar arrived and started abusing the informant and then he called his family members, whereafter the petitioner herein and other accused persons are said to have assaulted the informant side. It is alleged that the petitioner had assaulted the daughter-in-law of the informant by 'khanti',

Patna High Court Cr.Misc. No.62877 of 2017 (2) dt.11-01-2018 2/2 resulting in injury to her.

The learned counsel for the petitioner submits that the parties are close agnate, injury suffered by the daughter-in-law of the informant is simple in nature, the petitioner has a clean antecedent and there is previous enmity between the parties emanating from the land dispute.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender within six weeks before the concerned court, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gaya in connection with Atri PS case no. 87 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
