====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-07-2024 Heard learned counsel for the petitioners and learned APP for the State.
2. Learned counsel for the petitioners seeks bail in application of his arrest in a case registered for the offences punishable under Sections 147, 149, 337, 353, 427 and 329 of the I.P.C.
3. Learned counsel for the petitioners submits that the petitioners have antecedent of one case and have been falsely implicated in the instant case by the informant with general and omnibus allegation. It is next submitted that similarly situated co-accused, Akhilesh Paswan had approached this Court seeking
Patna High Court CR. MISC. No.32545 of 2024(3) dt.20-07-2024 2/2 anticipatory bail by filing Cr. Misc. No. 22396 of 2024 and the same was allowed by an order dated 23.04.2024. It is next submitted that since case of the petitioners are akin to Akhilesh Paswan as such based on parity petitioners be also granted the privilege of anticipatory bail.
4. The learned APP opposes the anticipatory bail application of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 585 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
