2. The petitioners have preferred this application for grant of regular bail in connection with Maranga P.S. Case No. 22 of 2025 dated 29.01.2025 registered for the offences punishable u/ss 310(4), 310(5) and 111 of the B.N.S. and Sections 25(1-B)(a), 26 and 37 of the Arms Act.
3. As per the prosecution case, the informant received a secret information that some unknown persons have assembled to make preparations for committing crime. On which the informant along with the police personnel reached the place of occurrence. On Seeing police, five to six persons along
Patna High Court CR. MISC. No.28453 of 2025(3) dt.14-05-2025 2/3 the roadside tried to flee away, out of which three persons were apprehended and they disclosed their name as Suman Kumar Yadav, Md. Rahmat (petitioner) and Bijali Nadaf (petitioner). On search, one loaded local made katta, three live cartrdges and two keypad mobile phone were recovered from the possession of the co-accused, Suman Kumar Yadav. One smart phone was recovered from the possession of the petitioner (Md. Rahmat). One mobile phone was also recovered from the possession of the petitioner (Bijali Nadaf).
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 09.01.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing
Patna High Court CR. MISC. No.28453 of 2025(3) dt.14-05-2025 3/3 bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Maranga P.S. Case No. 22 of 2025.
7. The application stands allowed.
