The petitioner has preferred this application for grant of regular bail in a case registered under sections 366A and 34 of the Indian Penal Code.
As per the prosecution case, the minor daughter of the informant was induced and taken away by the petitioner with the assistance of other accused persons. The informant apprehends that she may be killed or sold.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. wherein she has categorically stated that she was in love with the petitioner for

Learned counsel for the petitioner further submits that from perusal of the statement under section 164 Cr.P.C. it would transpire that the daughter of the informant has described herself to be aged 18 years and the Court assessed her age between 18-19 years. The petitioner is in custody since 15.2.2021 and has no criminal antecedent. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the statement under section 164 Cr.P.C., the petitioner having remained in custody for over 10 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Hasanpur P.S. Case no. 23 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Rosera, District- Samastipur.
