JUSTICE SANJAY PRIYA ORAL ORDER 22-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Goroul P.S. Case No. 187 of 2017 instituted for the offence under Sections 376, 366, 379 and 506/34 of the Indian Penal Code. From the written report it appears that the victim (informant) who is a married lady was having illicit relationship with the petitioner. It is alleged that the petitioner established physical relationship with the informant on pretext to marry her and also took an amount of Rs.80,000/- The victim (informant) has given her statement under Section 164 Cr. P.C. wherein similar statement has been made which is mentioned in the written report.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.62487 of 2017 (2) dt.22-12-2017 2/3 victim girl is a married lady. He has pointed out Annexure-3 wherein it is mentioned that both parties have filed compromise petition in the court below.
In this manner, from the allegation in the written report as well as statement of the victim (informant) recorded under Section 164 Cr. P.C., it appears that victim is a major married lady aged about 35 years and she was having illicit relationship with the petitioner on her own free will. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Garoul P.S. Case No. 187 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Vaishali (Hajipur), subject to the conditions as laid down under Section 438 (2) Cr. P.C. with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned,
(2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will
Patna High Court Cr.Misc. No.62487 of 2017 (2) dt.22-12-2017 3/3 automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
