The petitioner seeks bail in Muffasil P.S. Case No. 191 of 2021, registered for the offence punishable under Section 302 and other allied sections of the Indian Penal Code. As per the prosecution case, FIR named accused persons including this petitioner administered poison to the son of informant.

It is submitted on behalf of the petitioner that petitioner has been made accused in this case merely on suspicion. In fact, there was love affair between the son of informant and daughter of petitioner and the deceased has committed suicide, as the girl has refused to marry him. Moreover, petitioner is not the eye-witness of the occurrence. During course of investigation, the girl in her confessional

No.39621 of 2021(2) dt.05-10-2021 2/2 statement has stated that on the alleged date of occurrence, the deceased had gone to her house and pressurized her to marry with him, but she refused, thereafter, he consumed poison. Petitioner is in custody since 26.03.2021 having clean antecedent. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 191 of 2021, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, her bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
