JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Nawada Nagar P.S. Case No. 353 of 2019 registered for the offence under Sections 341, 323, 504, 506, 420, 379 of the Indian Penal Code. As per the prosecution case, the petitioner is alleged to have made a call from his mobile phone and called the informant at the court premises, but when the informant reached there, the petitioner was not present there and some unknown persons snatched key of motorcycle and mobile of informant and thereafter, they assaulted him by bricks. It is submitted on behalf of petitioner that petitioner is not alleged to have assaulted the informant. Only allegation

Patna High Court CR. MISC. No.29250 of 2020(2) dt.05-12-2020 2/2 against this petitioner is that, he made a call from his mobile and called the informant. It is stated in paragraph -3 of the petition that petitioner has no criminal antecedent.

Considering the nature of allegation and the fact that petitioner has got no criminal antecedent, the bail application is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 353 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
