Petitioner apprehends arrest in connection with Bakhtiarpur P.S. Case No. 437 of 2018 registered for the offence punishable under sections 420, 406, 409 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is the Junior Engineer of Ashthaniya Chhetra Abhiyantran Sangathan, Karya Pramandal, Saharsa. Petitioner is alleged to have made wrong entries in the measurement book resulting in excess payment. It is further submitted that petitioner has not made any wrong entry or payment. As a matter of fact, on technical enquiry the
Patna High Court CR. MISC. No.28499 of 2019(2) dt.02-05-2019 2/2 Executive Engineer did not find any irregularity in the alleged work as is evident from Annexure-3. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S. Case No. 437 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
