Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Rupauli P.S. Case No. 178 of 2015 for the offence punishable under Section 302/34 of the Indian Penal Code. It has been submitted by learned counsel for the petitioners that the Police has submitted the final form in the Court below exonerating the petitioners but the Court below differing with the same, has taken cognizance against the petitioners.

Patna High Court CR. MISC. No.39633 of 2021(2) dt.10-02-2022 2/2 Considering the aforesaid submission, this bail application is allowed.

Let the petitioners, above named, in the event of their arrest/surrender within ten weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea, in connection with Rupauli P.S. Case No. 178 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However before accepting the bail bonds of the petitioners, the Court below will verify the fact whether the Police has submitted the final form or not. If it is found that the same has been submitted then, the Court below will accept the bail bonds of the petitioners. However, if it is found that the Police has not submitted the final form, in such circumstance, the bail bonds of the petitioners shall not be accepted and they shall be taken into custody.
