2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 18.09.2024 passed in Cr. Misc. No. 38005 of 2024.

3. The petitioner seeks regular bail in a case registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

4. There is recovery of 4 pistols and 10 cartridges from the possession of the petitioner.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 14.12.2023.

7. Considering the facts and circumstances of the case as well as period of custody, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Siwan/concerned Court below in connection with Siwan Town P.S. Case No. 635 of 2023 subject to condition that:- (i).

The petitioner will mark his attendance at the Hussainganj Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (ii) Both the bailors will be close blood relatives of the petitioner.
