The petitioner seeks bail in connection with Mahila (Bhabua) P.S. Case No. 66 of 2017 dated 13.11.2017 registered for the offence punishable under Sections 498A, 354/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The allegation is with regard to demand of motorcycle as dowry and torture to the informant on the part of the petitioner.
Learned counsel for the petitioner submits that the petitioner is the husband of the informant and he has neither
Patna High Court CR. MISC. No.30428 of 2023(2) dt.12-06-2023 2/2 demanded any dowry nor tortured the informant. The informant herself does not want to live with the petitioner and she has solemnized her second marriage with someone else. Learned counsel further submits that in the Mediation, the informant herself has not appeared before the learned Mediator. The petitioner has no criminal antecedent and is in jail custody since 16.02.2023.
Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Kaimur at Bhabua in connection with Mahila (Bhabua) P.S.
