Petitioner apprehends his arrest in connection with Trial No. 1954 of 2017, arising out of Complaint Case No. C-1390 of 2017 in which cognizance has been taken under Sections 323, 341, 447, 451 and 354/34 of the Indian Penal Code. Allegation against the petitioner is that he tried to disrobe the complainant and submission of learned counsel for the petitioner is that there is land dispute between the parties and petitioner is debar of the complainant and earlier such type of case has been lodged in which Panchayati was held (Annexure-2). Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.41797 of 2018 (2) dt.19-07-2018 2/2 circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sadar, East Champaran, Motihari, in connection with Complaint Case No. C-1390 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
