====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code.
3. As per the F.I.R., on the alleged date and time of the occurrence, all the F.I.R. named accused persons including this petitioner came at the land of the informant and started dumping sand. On objection, all the accused persons assaulted informant's side by means of lahi, danda and iron rod.
4. It is submitted that both parties are agnates and next door neighbours and due to petty dispute, an altercation took place between them in which both sides sustained injuries. Case and counter case. Injury allegedly caused by this petitioner is simple in nature. Petitioner claims clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Gopalganj in connection with Gopalpur P. S. Case No. 234 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
