The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Didarganj P.S. Case No. 198 of 2018 (G.R. No. 5741 of 2018) registered for the offence punishable under sections 420, 406, 379 and 34 of the Indian Penal Code.

The allegation as per the F.I.R. is that the informant's furniture etc., which he had given to one Abhay Kumar for transportation and reaching the same by his Ashok Leland vehicle was stolen and the informant lost his furniture worth Rs. 70,000/-. It is further alleged in the F.I.R. that the petitioner who was the nephew (Bhagina) of the said driver-cum-owner Abhay Kumar was also with him.

No.27367 of 2019(3) dt.17-07-2019 2/2 It is submitted by learned counsel for the petitioner that the allegations in the F.I.R. are mainly against Abhay Kumar while the petitioner who is a student has been falsely implicated because of his relationship with the aforesaid Abhay Kumar. The petitioner has no criminal history. Having heard learned counsel for the parties and taking into consideration the facts and circumstance of the case and the nature of allegations, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Didarganj P.S. Case No. 198 of 2018 (G.R. No. 5741 of 2018) is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Patna City, Patna subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code.
