2. The petitioner apprehends his arrest in connection with Siwan (Muffasil) P.S. Case No. 822 of 2025, for allegedly having committed offence under Sections 126(2), 329(3), 125(b), 74, 352, 351(2) and 3(5) of the BNS.
3. As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant to the effect that on 28.11.2025 at about 9:50 A.M., the petitioner along with others surrounded him and started using filthy language. When the informant told them not to do so, all the accused persons started assaulted him with stick, fist and leg etc., which caused injuries on his stomach and back. Thereafter, the petitioner started pressing the neck of the
Patna High Court CR. MISC. No.30995 of 2026(2) dt.06-05-2026 2/3 informant with Gamchha. When the wife of the informant came to save him, the petitioner pulled her on the ground and also assaulted her.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The present case has been lodged by the informant on account of land dispute and local village politics. He further submits that there is case and counter case between the parties. The petitioner's side also lodged Muffasil P.S. Case No. 823 of 2025 under different sections of the B.N.S.S. He further submits that the injuries were found to be simple in nature. He submits that the petitioner is also an accused in Muffasil P.S. Case No. 233 of 1987.
5. The learned APP for the State vehemently opposes the prayer for bail of the petitioner.

Having heard the learned counsel for the parties and from going through the records, it appears from the impugned order dated 26.02.2026 passed by the learned Sessions Judge, Siwan that the petitioner was an accused in Siwan Muffasil P.S. Case No. 233 of 1987, for which Trial No. 776 of 1998 (GR No. 2242 of 1987) is pending and the petitioner has been declared an absconder in the trial and
Patna High Court CR. MISC. No.30995 of 2026(2) dt.06-05-2026 3/3 permanent warrant has been issued against him way back in 1998. Considering the above, the prayer for anticipatory bail of the petitioner is rejected.
