The petitioner seeks pre-arrest bail in connection with Chandi P.S. Case No. 21 of 2018 registered under Sections 147, 148, 149, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted that there is no truth behind allegation made in the first information report. Neither the petitioner was armed with any weapon nor anyone sustained any injury. From perusal of first information report itself, it would transpire that owing to land dispute, some altercation took place whereafter an
Patna High Court Cr.Misc. No.43001 of 2018 (2) dt.20-07-2018 exaggerated version was reported to the police against the petitioner.
Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Considering the fact that nobody sustained any injury and the petitioner is a man of clean antecedent, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- XII, Bhojpur at Ara in connection with Chandi P.S. Case No. 21 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/SkSuman.
