The petitioner seeks bail in a case registered under Section 397, 302 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that the informant received an information that criminals have shot dead a person and whose dead body is lying on NH-2 and a car is standing there. On this information, the informant along with other police personnel reached at the P.O. and feld that the vehicle was of cash van and the person was looking the driver of cash van. The people who were gathering there stated that six accused persons were on two motorcycles came and they have committed the occurrence and other employee of cash van are seriously injured.

Patna High Court CR. MISC. No.29595 of 2019(4) dt.27-08-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.2.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest his implication in this case. There is no eye witness to the alleged occurrence. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 10, Saran at Chapra in connection with Garkha P.S. case No.489 of 2017.
