JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 18-07-2016 Heard Mr. Vijay Shankar Srivastava in support of the application. No one has appeared on behalf of the State. Petitioner claims right, title and interest in respect of the subject land detailed in paragraph 10 of the application. The grievance is that the private respondent nos. 12 and 13 had presented document of title/possession in respect thereof before

Looking through the writ petition, prima facie, it appears, it is a dispute between the two parties, may be agnates, in respect of the subject land. It has further been submitted that the Circle Officer also vouched in favour of the private respondent quite illegally. If any wrong has been committed by the Revenue Authority, the matter can be agitated before the District Collector for consideration and disposal in accordance with law.

Mr. Srivastava, after making submissions at some length, submits that the petitioner would ventilate his grievance with regard to the illegalities committed by the Circle Officer or the other Revenue Authority before the respondent District Collector.

The writ application stands disposed of granting the petitioner the said liberty. Needless to observe that if any such application/representation is filed within a reasonable period of time, the same shall receive due consideration and disposal at the hands of the respondent District Collector in accordance with law as quickly as possible preferably within three months from such filing/presentation.
