JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner, counsel for the informant and learned A.P.P for the State. The petitioner seeks bail in Bihariganj P.S. Case No. 258 of 2019, registered for the offence punishable under Section 366/34 of the Indian Penal Code.

As per the prosecution case, on 09.06.2019 the informant got information that his daughter namely, Sabana Khatoon aged about 21 years is missing and ornaments and clothes and cash of Rs. 82,000/- are also missing. On 01.07.2019, one call of unknown person came on mobile of informant's son who informed that Sabana has died. It is further alleged that after hatching up criminal conspiracy the accused persons including this petitioner committed murder of his daughter.

In fact, this petitioner married with deceased and were living in Delhi. After two months of pregnancy the deceased became sick and during treatment died in Delhi. Petitioner is in custody since 28.11.2019 having no criminal antecedent.

Counsel for the informant however, vehemently opposed the prayer for bail and submitted that petitioner took away the deceased and later on died on 01.07.2019 in Delhi. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
