The petitioner seeks bail in S.Tr. No.713 of 2015 arising out of Sugauli P.S. Case No.293 of 2015 registered under Section 302 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by order dated 05.09.2018 but on query, learned counsel for the petitioner submits that now the prosecution witnesses have been examined. The statement of the accused persons were recorded under Section 313 Cr.P.C. Since the case is pending at the instance of the accused and there is specific allegation that it was petitioner who fired causing the death of the driver, Meghu Sahni, I am not inclined to enlarge the petitioner on bail.
