====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-12-2020 Heard learned counsel for the petitioner and the State through Video Conferencing.

Petitioner apprehends arrest in a case registered for the offence punishable under Section 420/34 of the Indian Penal Code and Section 7 of the E.C. Act.

As per the prosecution case, petitioner is the driver of the alleged vehicle bearing Registration No. BR 07 GA 1750 which is alleged to be involved in the occurrence. It is submitted on behalf of the petitioner that petitioner has got no concern with the alleged recovery and he is simply the driver and moreover, owner of the godown has already been granted bail by this hon'ble Court. It is stated in paragraph no.3 of the bail petition that petitioner has got clean

Learned counsel for the State, on the other hand, opposes the prayer for bail.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Jhanjharpur, DistrictMadhubani in Jhanjharpur Police Station Case No. 113 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
