Mr.Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 Petitioner seeks regular bail in connection with Chautham P.S. Case No.77 of 2016 registered for the offences punishable under Sections 392/34 of IPC.
Petitioner is not named in the F.I.R. and the allegation as per F.I.R. is that petitioner and three miscreants came on the point of pistol and taken away the motorcycle and snatched the mobile phone and cash of Rs.7600/-.
Submission of the learned counsel for the petitioner is that the motorcycle was recovered from his possession and for that a case was registered in the year 2016 and now he has remanded in this case. He is in custody since 11.10.2018 and the charge sheet has been submitted as such, there is no chance of tampering with the evidence and he is on bail in all these cases. Heard learned A.P.P. also.

No.30855 of 2019(2) dt.23-05-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Chautham P.S. Case No.77 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
