The petitioner is accused in connection with Hiranmar P.S. Case No. 06 of 2017 registered under sections 302, 34 of the I.P.C. and section 27 of the Arms Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case merely on the basis of suspicion and dirty politics. Further submission is that petitioner is in custody since 31.07.2018.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation against the petitioner of firing at the chest of Doman Manjhi, who died on the spot. The witnesses have also supported the version of the prosecution.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.28570 of 2019(4) dt.08-07-2019 2/2 case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, liberty is given to the petitioner to renew his prayer for bail after framing of charge.
