====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-10-2020 Heard Mr. Kedar Jha, learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Maniganchi P.S. Case No. 89 of 2020, dated 19.04.2020, instituted for the offence under Section 7 of the Essential Commodities Act.

It has been submitted on behalf of the petitioner he is seventy years old and has been running the P.D.S.

Patna High Court CR. MISC. No.25713 of 2020(2) dt.14-10-2020 2/2 shop for the last thirty four years. The allegation of black marketing against him is absolutely false. The accusation against the petitioner do not make out any sense. Wrongly the stock of the godown has been seized and the present criminal case has been lodged maliciously.

Considering the nature of accusation against the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-V, Darbhanga, in connection with Manigachi P.S. Case No. 89 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
