2. Petitioner apprehends arrest in Gaurichak P. S. Case No. 695 of 2025 registered for the offences punishable under Sections 318(4), 316(2), 338, 336(3), 336(4), 340(2), 126(2), 115(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. Informant alleges that the accused persons induced him to purchase land and relying upon the documents, informant paid total consideration amount of Rs. 52 lacs. Subsequently, informant discovered that the promised access to the road did not exist. It is alleged that this petitioner along with other accused persons cheated informant by showing forged
Patna High Court CR. MISC. No.30017 of 2026(4) dt.09-07-2026 2/3 documents and obtained Rs. 52 lacs as consideration money and when informant confronted, the accused persons abused and assaulted him.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Present case has been filed to pressurize and harass the petitioner. Petitioner is ready to register the land according to agreement paper bearing No. 888 dated 24.05.2025 and Stamp Paper No. PA767612 (Annexure-P/2). By filing supplementary affidavit, petitioner submits that he is a farmer and has no other source of income. He can only repay the alleged amount by selling his land and requests Court to allow him to repay the amount in 24 installments. In this regard, petitioner has already submitted an application to the Housing Board for permission to sell his land in accordance with the rules and regulations of the Government of Bihar on 3rd July, 2026 (Annexure-P/2 of supplementary affidavit).
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that this petitioner committed fraud with the informant and misappropriated Rs. 52 lacs as advance money. Initially, petitioner, fraudulently and dishonestly, on the

No.30017 of 2026(4) dt.09-07-2026 3/3 basis of forged and fabricated documents, showed informant a land-locked land by promising access to approach road but subsequently, informant came to know that there was no approach road and land in question was completely land-locked. Thus, there was fraudulent and dishonest intention from the very beginning of the transaction, by promising approach road. He further submits that petitioner has got three criminal antecedents.
6. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
