The petitioner seeks bail in connection with Madhepura Mahila P.S. Case No. 33 of 2022 dated 04.07.2022 registered for the offence punishable under Sections 341, 323, 376, 354(D), 504, 506/34 of the Indian Penal Code. As per the prosecution case, the co-accused Anurag Kumar Anu sexually exploited the informant on pretext of marriage but now he denied to marry her and threaten her. Learned counsel for the petitioner submits that the specific allegation of sexual exploitation with the informant is against co-accused, namely, Anurag Kumar Anu @ Anurag Kumar and the petitioner has been falsely implicated in this case
Patna High Court CR. MISC. No.30432 of 2023(2) dt.12-06-2023 2/2 due to ulterior motive and no case is made out against the petitioner. It is further submitted that the co-accused Anurag Kumar Anu @ Anurag Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dated 23.05.2023 in Cr. Misc. No. 27019 of 2023. The petitioner is in custody since 17.01.2023.
Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhepura in connection with Madhepura Mahila P.S. Case No. 33 of 2022.
