JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-09-2018 The petitioners, along with others, were granted bail by order dated 05.02.2018, passed in Cr. Misc. No. 4707 of 2018 with the condition that they would surrender before the learned court below within a period of four weeks from the date of passing of the order and would furnish bonds in the sum of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned court below.
It has been submitted on behalf of the petitioners that because of the straightened financial
Patna High Court Cr.Misc. No.47234 of 2018 (2) dt.07-09-2018 2/2 condition of the petitioners, they went outside the State of Bihar to earn their livelihood. For the aforesaid reason, they could not surrender before the court below within stipulated time to take advantage of the order referred to above. A prayer, therefore, has been made to modify the aforesaid order by extending the time for their surrender before the court below.
Regard being had to the grounds raised by the petitioners in the present petition, the order dated 05.02.2018, passed in Cr. Misc. No. 4707 of 2018, is modified to the extent that the petitioners, above named, on their surrender before the court below within a period of two weeks from today, shall be released on bail on their furnishing bonds in the sum of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Simri Bakhtiyarpur P.S. Case No. 140 of 2017.
With the aforesaid modification in the order dated 05.02.2018, the petition is allowed.
