JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-12-2020 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. Heard the learned counsel for the petitioners and Sri Arun Kumar Pandey, the learned A.P.P. for the State. This is an application for grant of anticipatory bail in connection with Mainatand PS case no. 91 of 2019 registered for the offences punishable under Sections 382 and other allied sections of Indian Penal Code.
At the outset, the learned counsel for the petitioners seeks to withdraw the present petition qua the petitioner no. 13. Accordingly, the present petition qua the petitioner no. 13 stands dismissed as withdrawn.
The accused-petitioners along with others, variously armed with sticks, spear, spade, katari etc. had assembled on the land of the informant and had cut the paddy crops as also had assaulted the informant.
The learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.31386 of 2020(2) dt.23-12-2020 3/3 that the petitioners are innocent and have been falsely implicated in the present case. It is further submitted that the occurrence in question had taken place on account of previous land dispute and a general and omnibus allegation has been levelled against the petitioners herein.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the bad antecedent of the petitioners herein, I am not inclined to grant anticipatory bail to the petitioners herein, hence the present petition stands dismissed.
