The petitioner seeks bail in anticipation of his arrest in connection with Paroo P.S. Case No. 467 of 2019, dated 08.11.2019, instituted for the offences under Sections 307 and 34 of the Indian Penal Code and Sections 30 and 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
It appears that one Dharmendra Das was arrested from a truck from where huge quantity (2232 litres) of
Patna High Court CR. MISC. No.32312 of 2020(2) dt.08-02-2021 2/2 liquor was recovered.
Learned counsel for the petitioner has submitted that his name has transpired only in the confession of arrested accused persons. It has further been submitted that the petitioner does not have criminal antecedents. Learned counsel for the petitioner, therefore, submits that the nature of accusation against him does not make out a case under the Excise Act.
Considering the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Paroo P.S. Case No. 467 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
