The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 354, 452, 435, 504, 506/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the accused persons came and assaulted her and her family members. Further, Hira Lal Yadav tore her cloth and petitioner along with Kanhaiya Yadav assaulted her Dewar and fled after firing.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that the allegation of assault is general and

Patna High Court CR. MISC. No.29549 of 2022(2) dt.16-11-2022 2/2 omnibus in nature. It is next submitted that as far as allegation of firing is alleged, the same is ornamental as no one was injured.

The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pranpur P. S. Case No.75 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
