Petitioner seeks bail in Dagarua P.S. Case No.157 of 2018 instituted for the offence under Section(s) 353, 307 Indian Penal Code and Sections 8/20(b) (ii)(c), 25 of the NDPS Act. Counsel for the petitioner submits that there is no recovery of contraband Ganja from possession of the petitioner. Ganja has been recovered from Bolero vehicle. The driver of the aforesaid vehicle, namely Vicky Sahani, disclosed before the police that he was going to deliver Ganja on the information received from Pawan Paswan to Mohan Rai and Sandeep Singh, who are coming by Swift Dzire car.

Petitioner is in custody since 06.08.2018 having clean

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, NDPS Act, Purnea, in connection with Dagarua P.S. Case No.157 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
