Patna High Court CR. MISC. No.29053 of 2020(3) dt.15-12-2020 2/2 The prosecution case is that informant's son had an altercation with co-accused for occupying seats at a dance show. Later on in the night co-accused Hari Shankar returned along with this petitioner and upon identification of Hari Shankar, petitioner has shot the informant's son Raja Kumar.

Learned Counsel for the petitioner submits that only one firing is alleged against the petitioner, whereas four empty cartridges have been recovered by the police. The petitioner is innocent and his implication is based on extraneous consideration in view of earlier altercation. He is in custody since 7.2.2020. Learned APP has opposed the prayer for bail. It is submitted that the informant's son has died. Allegation of causing fetal fire arm injury is specifically stated against the petitioner by the informant as an eye witness of the occurrence. The nature of offence does not entitle the petitioner for grant of bail. Considering the rival submissions, for the present, the prayer for bail of the petitioner is rejected.
