JUSTICE KHATIM REZA ORAL ORDER 13-08-2025 Heard learned counsel for the petitioner; learned Additional Public Prosecutor for the State and learned counsel for the informant, who has appeared suo motu.

2. The petitioner seeks bail in connection with Didarganj PS Case No.188 of 2024 dated 24.05.2024, instituted for the offence punishable under Sections 302, 341, 324, 326, 307/34 of the Indian Penal Code.

The prosecution case, in brief, is that on the alleged date of occurrence the petitioner and other named accused persons surrounded the brother of the informant, Raushan Kumar @ Niraj and assaulted him by knife and Gandsa and then the informant and his son, Nirala, reached to save him. Learned counsel for the petitioner submits that from the FIR itself it is apparent that land dispute is going on between the parties and the petitioner and others have been implicated in this case only to settle the score. Further submission is that there is vague and omnibus allegation against the petitioner. It is also also submitted that in the FIR it is alleged that the petitioner was holding pistol and knife and he also assaulted the deceased, but no firearm injury has been found during postmortem. Lastly, it is submitted that the petitioner is in custody since 12.07.2024 and two cases under the Excise Act are pending against the petitioner.

5. Learned APP as well as learned counsel for the informant has opposed the prayer for bail.

6. Perusal of the postmortem report shows that four external injuries were found on the person of the deceased. There is direct allegation against the petitioner also.

7. Having regard to the nature of allegation which is supported by the postmortem report, I am not inclined to grant

8. Accordingly, prayer of the petitioner for grant of bail is rejected for the present.

9. The Trial Court is directed to expedite the trial and take all endeavour to conclude the same as early as possible, preferably, within a period of nine months from the date of receipt/production of a copy of this order.

10. The application stands dismissed.
