JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-01-2022 Heard Mr. Ashok Kumar Jha, learned counsel for the petitioner and Ms. Sangeeta Sharma, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Kanhauli PS Case No. 107/2016 registered for the offence punishable under Sections 341, 323, 324, 325, 307 and 504 of the IPC.

As per First Information Report, the petitioner along with two accused persons arrived at the house of informant and petitioner, allegedly, gave a Farsa blow to the wife of the informant due to which she sustained injury.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to previous

The petitioner is next door neighbour of the informant and there is case and counter case between the parties inasmuch as daughter of co-accused has lodged Kanhauli PS Case No. 108 of 2016 under Section 354 and other allied Sections of the IPC. Learned counsel further submits that petitioner is in custody since 17.01.2021 and the charge-sheet has already been submitted.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that both the parties are neighbours and there is case and counter case between them, petitioner is in custody since 17.01.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, GOVIND RAI @ GOVIND KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Kanhauli PS Case No. 107/2016.
