JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-02-2018 Heard the learned counsel for the petitioner and learned APP for the State.

In this application, the petitioner apprehends his arrest for the offences in connection with Pandarak P.S. Case No. 07 of 2016 punishable under Sections 448, 341, 323, 354, 504 of the Indian Penal Code.

Allegedly, the petitioner told the informant to come to his house to work on wages, to which the informant refused and then the petitioner abused and assaulted her. It is also alleged that the petitioner used to knock the door in the night and looks the daughter of the informant with bad intention. Submission is of false submission and that no such occurrence has taken place. The petitioner is never indulged in such activity. The only allegation is for abusing and assaulting by

Patna High Court Cr.Misc. No.63149 of 2017 (2) dt.01-02-2018 2/2 fists and slaps and other allegations are based on only surmises and conjectures and, as such, the petitioner deserves sympathetic consideration as he has got no antecedent.

Learned APP opposes the prayer of pre-arrest bail. Considering the facts and circumstances as stated above, the petitioner, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order shall be enlarged on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Pandarak P.S. Case No. 07 of 2016 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
