He was transferred from Supoul to Aurangabad through order dated 18.6.2015. Challenging the same, the writ petition was filed. Learned single Judge dismissed the writ petition through order dated 2.7.2015, observing that the petitioner stayed at Supoul for 30 years.
Heard Shri Anil Kumar Jha, learned senior counsel for the appellant and Shri Prabhu Narayan Sharma, learned counsel for the respondents.
We do not find any basis to interfere with the
Patna High Court LPA No.1346 of 2015 dt.29-07-2015 2/2 order of transfer at all. It is a matter of surprise that the appellant remained at the same station for three decades, virtually for the entire length of service. No exception can be taken either to the order of transfer or to the order passed in the writ petition.
Letters Patent Appeal is disposed of upholding the order in the writ petition. If, however, the appellant is of the view that he can be posted at a nearby location, he can make a representation for posting at another station. The concerned authority shall look into the representation and pass an order depending on the merits, within two months provided the representation is made after joining the station at Aurangabad.
Interlocutory application, if any, stands disposed of.
There shall be no order as to costs.
