JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-02-2018 The petitioners seek bail in anticipation of their arrest in connection with Sirdala P.S. Case No. 287 of 2016 dated 02.12.2016 instituted for the offences under Sections 147, 148, 341, 323, 307, 436, 447, 379 of the Indian Penal Code. The petitioners are said to have come to the house of the informant, abused and assaulted him as well as his other family members.

Learned counsel for the petitioners has submitted that the present prosecution is because of the old land dispute between the parties. Only some burnt articles were found at the place of occurrence which would not substantiate the

Patna High Court Cr.Misc. No.4567 of 2018 (3) dt.02-02-2018 2/2 allegation with respect to the commission of offence under Section 436 of the Indian Penal Code. Most of the injuries found on the injured persons were opined to be simple and not dangerous to life. There has been a settlement between the parties as well. For the facts stated above, the petitioners above named are directed to be released on bail, in the event of their surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Sirdala P.S. Case No. 287 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Ashutosh Kumar, J) Shageer/- U T
