The petitioner is apprehending his arrest in connection with Siwan Excise Case No. CIII 151 of 2021 pending in the Court of learned Additional District & Sessions Judge-II-cum-Special Judge Excise, Siwan in a case registered for the offences punishable under Sections 30(a) of the Bihar Excise Prohibition Amended Act, 2016.

It is a case of recovery of about 50 liters of country made liquor from the hut of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent.

Patna High Court CR. MISC. No.40752 of 2021(2) dt.03-03-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In view of the fact that the said wine was recovered from the hut of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
