The petitioner apprehends his arrest in Konch P.S. Case No.53 of 2019 registered under Section 307 and other sections of the Indian Penal Code.

The informant named the petitioner along with other accused persons and alleged that they all having armed with different weapons came to his door and Firoz Ansari (petitioner) assaulted with the butt of pistol on the head of the informant. The other accused persons are alleged to have pelted stones. Learned counsel for the petitioner submits that the informant himself stated in the F.I.R. that on account of land dispute the occurrence took place. There is no intention to kill the informant. The petitioner is alleged to have assaulted the informant with butt of pistol on his head. There is no repetition

Having considered the fact that the petitioner is alleged to have assaulted the informant with butt of pistol but the injury report has not been brought on record even after several adjournments and the fact that the occurrence took place due to land dispute, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Konch P.S. Case No.53 of 2019, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
