The petitioner seeks pre-arrest bail in connection with Rivilganj P.S.Case No. 223 of 2017 registered under Sections 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the present case is nothing but has been got registered by the informant only in order to save his own skin from Rivlganj P.S.Case No. 224 of 2017, as contained in Annexure-2 to the present application, registered under Sections 341, 323, 354, 379, 427, 504, 34 of the Indian Penal Code and Section 3(A)(R) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. He submitted that since all the
Patna High Court Cr.Misc. No.1327 of 2018 (2) dt.19-01-2018 2/2 injuries sustained by the informant are simple and superficial and in respect of one of the injuries opinion has been reserved, the offence punishable under Section 307 of the Indian Penal Code would not be attracted.
Learned counsel for the State opposed the application for grant of pre-arrest bail of the petitioner. Having regard to the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- VIII, Saran at Chapra in connection with Rivilganj P.S.Case No. 223 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
