14-03-2018 Heard Sri Krishna Mohan Mishra, learned counsel for the petitioners and Sri Madan Kumar, learned Addl. Public Prosecutor.
Two petitioners, apprehending their arrest in Telhara P.S. Case No. 29 of 2017 registered for offence under Sections 406, 409, 420 & 120(B) of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender. Both the petitioners are rice miller and they have been arrayed as accused in the F.I.R. The allegation against the petitioners is that they had supplied much lesser rice to the PACS, whereas, huge quantity of paddy was received by the
Patna High Court Cr.Misc. No.7069 of 2018(3) dt.14-03-2018 2/2 petitioners.
Learned counsel for the petitioners tried to persuade the Court that in view of new agreement, no offence is made out. He further submits that actually, the petitioners had already supplied rice in accordance with law.
Besides hearing, I have also examined material on record and after going through the same and considering the fact that both the petitioners have been arrayed as accused in the F.I.R. with specific accusation, there is no reason to pass favourable order.
