2. The petitioner has preferred this application for grant of regular bail in connection with Karakat P.S. Case No. 423 of 2023 dated 13.12.2023 registered for the offences punishable under sections 365 & 366 of the Indian Penal Code and u/s 12/17 of the POCSO Act, 2012.

3. As per the prosecution case, the petitioner and coaccused person are alleged to have kidnapped the minor daughter of the informant for the purpose of the marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.34341 of 2024(2) dt.14-05-2024 2/3 this case. The statement of the victim recorded u/s 161 Cr.P.C., in which she stated that she was not kidnapped by the petitioner. She had already pressurized the petitioner to flee away when her marriage was fixed with another person. There was love affair between the victim and the petitioner. The statement of the victim u/s 164 Cr.P.C. in which she stated that she was not forced to have illicit relationship with another person. On 12.12.2023, both the victim and the petitioner went to Delhi and solemnized marriage. The medical report also not support either intercourse or any sexual harassment as stated in para 13 of the bail petition. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 03.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sasaram in connection with Karakat P.S. Case No. 423 of 2023.
