JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and the respondents.

The writ application has been filed for setting aside order as contained in Memo no. 634 dated 16.05.2013 whereby the respondents did not consider the case of the petitioner for appointment from the panel of Daily Wages Workers. The petitioner applied for appointment on the post of Generator Operator pursuant to notice dated 20.10.2003 and appointment letter was issued on 31.10.2003 in his favour. The petitioner started duty as Generator Operator on daily wage basis from 01.11.2003.

The petitioners submit that the post of peon is vacant

Patna High Court CWJC No.18807 of 2013 (3) dt.09-11-2015 2 / 2 in the Block office due to death of one employee, namely, Krit Narayan Singh, on 15.10.2004. He further submits that he has worked more than 240 days and as such he seeks regularization of his appointment/engagement. The petitioner has already filed his representation on 29.08.2008 before the Block Development Officer, Sultanganj, Bhagalpur and before the respondent no. 4 on 14.11.2008, which were rejected.

If the petitioner files a fresh representation before the appropriate authority, the same would be disposed of within a period of four months from the date of receipt of a copy of this order.

This application stands disposed of.
