The petitioner apprehends his arrest in Raja Pakar(Baranti O.P.) P.S. Case No.84 of 2018 registered under Sections 363 and 366A of the Indian Penal Code. The informant alleged that his daughter gone to market along with her younger sister but Mantu Paswan with the help of others kidnapped the eldest daughter of the informant. The younger sister of the victim informed the informant about the occurrence and when the informant went to the house of Mantu Paswan, the brother and family members of Mantu Paswan are alleged to have abused the informant.
The learned counsel for the petitioner submits that the petitioner is brother of Mantu Paswan. The petitioner was in his
Patna High Court Cr.Misc. No.42434 of 2018 (2) dt.20-07-2018 house. There is no allegation of kidnapping against the petitioner. The daughter of the informant was having love affairs with Mantu Paswan who fled away with the victim.
Taking into consideration the facts aforesaid and the fact that the petitioner is brother of Mantu Paswan, who is alleged to have kidnapped the victim, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Raja Pakar P.S. Case No.84 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
