2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. The perusal of the first information report and the seizure list would go to show that a total of 27 litres of foreign liquor was recovered near the motorcycles.

4. It has been submitted on behalf of the learned counsel for the petitioner that the name of the petitioner has surfaced in this case only on the basis of suspicion and upon a disclosure made by the unknown police spy. The petitioner is neither the owner of the seized motorcycles nor he has any

Patna High Court CR. MISC. No.30101 of 2025(3) dt.19-06-2025 2/3 concern with the seized liquor. It is submitted that he has been made accused in this case only on the basis of he having criminal antecedents of similar nature. Further, there is no independent witness to the seizure list.

5. Learned APP for the State opposes the prayer for anticipatory bail on ground that the petitioner has four cases of similar nature. However, it has been submitted in response that the petitioner is on bail in all the cases.

6. In view of the aforesaid facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Matihani P.S. Case No. 13 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-Cum-Special Judge, Excise Act, Begusarai, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023 and further condition that the petitioner would co-operate in the process of investigation/trial and would make himself available and mark his attendance in the office of the Superintendent of Police of the concerned
