This is an application for grant of anticipatory bail in connection with Chowk PS case no. 334 of 2017 registered for the offences punishable under Sections 307/34 of Indian Penal Code and 27 of Arms Act.
The allegation is regarding accused persons assaulting the informant and thereafter, co-accused namely Vishal firing from his pistol resulting in injury in the left leg of the informant.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and infact, whatsoever allegation is there, it is against the co-accused namely Vishal and the petitioner has got no role to play in the present case. It is further submitted that the petitioner has a clean
Patna High Court Cr.Misc. No.62954 of 2017 (2) dt.11-01-2018 2/2 antecedent and he has got nothing to do with the alleged incident. Having regard to the facts and circumstances of the case as also the fact that the petitioner has a clean antecedent, I deem it fit and appropriate to enlarge the petitioner on anticipatory bail.
Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 1,00,000/- (Rs. one lac) with two sureties of the like amount each to the satisfaction of Shri S. Ranjan, Judicial Magistrate, Patna City in connection with Chowk PS case no. 334 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure. It is further directed that the petitioner shall appear before the concerned court on each and every date fixed by the court and in case of two consecutive defaults in appearance, the present privilege of anticipatory bail shall stand cancelled automatically and the petitioner would be arrested forthwith.
