JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-01-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Mahua P.S. Case No. 476 of 2015 registered for the offence punishable under Sections 302/34, 120 (B) of the Indian Penal Code and Section 27 of the Arms Act. According to the F.I.R., two unknown persons are said to have come to the house of the informant and killed the daughter of the informant and fled away. However, on the basis of suspicion, the petitioner has been roped in, who is said to be the husband of the deceased-victim.
The learned counsel for the petitioner submits that

No.63228 of 2017 (2) dt.11-01-2018 2/3 merely on suspicion, the petitioner has been roped in, however, the marriage of the petitioner with the victim lady had been solemnized about 15-16 years ago and there are three sons out of the wedlock, hence, there cannot be any motive on the part of the petitioner to kill the daughter of the informant. It is further submitted that the petitioner is ready to join investigation and the petitioner has a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the even of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 476 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is directed that the petitioner shall join investigation and he would be present at the place where he is directed to appear by the investigating agency. In case, the prosecution finds that the petitioner is not cooperating in the investigation, the
Patna High Court Cr.Misc. No.63228 of 2017 (2) dt.11-01-2018 3/3 prosecution would be free to approach this Court for cancellation of bail.
