Learned counsel for the petitioner submits that the petitioner was granted bail by the police but thereafter charge sheet was submitted and cognizance was taken. Since the petitioner was on police bail, the anticipatory bail petition is dismissed as permitted to be withdrawn. If the petitioner surrenders in the court below and pray for regular bail, the court below shall pass order on the bail petition, keeping in view of the fact that the petitioner was on police bail during the course of investigation.
