====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Bangaon P.S. Case No. 17 of 2019, instituted for the offence under Section(s) 302, 201 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that there is no direct evidence of committing overt act against the petitioner. It is alleged in the written report that son of the informant had gone with this petitioner by vehicle to attend marriage ceremony of sister of Vikas Jha. The informant got information that firing had taken place during marriage ceremony. In the firing, the son of the informant had sustained
Patna High Court CR. MISC. No.28393 of 2019(2) dt.01-05-2019 2/2 gun shot injury and he died. The informant reached Sadar Hospital and found the dead body of her son lying in the vehicle from which he had gone to attend marriage ceremony. Counsel for the petitioner submits that besides suspicion, there is no allegation of any specific overt act against the petitioner. Petitioner is man of clean antecedent. He is in custody since 5.3.2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saharsa, in connection with Bangaon P.S.
